U.S. Court rules that QIPC has no selling restrictions while patent infringement case is being decided

Sussex, WI--8 April 2010--On Tuesday, the United States District Court for the Eastern District of Pennsylvania ruled that there would be no temporary restrictions placed on Q.I. Press Controls (QIPC) while the patent infringement trial takes place. QuadTech’s claim, filed in June 2009, alleges that Q.I. Press Controls’ register control product (mRC) infringes on U.S. Patent 5,412,577 in both mark and markless mode. The trial date has not yet been set.

Statement from Karl Fritchen, President of QuadTech:

“The U.S. Court will be considering the patent infringement claim against Q.I. Press Controls (QIPC). We appreciate the Court's time and attention to the matter of our preliminary motions. While we are disappointed that QIPC won the right to continue selling while the trial proceeds, this is just the first step in a long process. We believe our case is strong and that QIPC’s mRC system infringes our intellectual property in mark and markless mode. We are confident that the outcome of the case will confirm this infringement. In the meantime, we will continue to protect our patent rights against QIPC to protect our intellectual property.”

The U.S. court case follows a German court decision that stopped Q.I. Press Controls from infringing on a related patent in Germany. On June 17, 2008, the Düsseldorf district court held in QuadTech’s favor that Q.I. Press Controls cannot market or otherwise sell its infringing mRC (markless register control) system in Germany. The Court of Appeals in Germany upheld this injunction against Q.I. Press Controls.
